Abstract(s)
A reabilitação urbana é um tema inevitavelmente presente, no discurso dos vários
intervenientes, quando se pretende intervir na cidade.
Enquanto processo integrado, implica uma abordagem que não se centra apenas na
reabilitação física dos edifícios mas que apreende as especificidades da área a reabilitar, as
suas carências e potencialidades, nas suas diversas dimensões.
No contexto atual, face às dinâmicas urbanas associadas a fatores económicos e sociais,
importa enumerar e interpretar os instrumentos disponíveis e a ação dos seus intervenientes.
A presente tese debruça-se sobre o atual instrumento de atuação no âmbito da
temática da reabilitação urbana, o Regime Jurídico da Reabilitação Urbana (RJRU), e analisa
qual a incidência da sua aplicação e operacionalização, no quadro da ação municipal, com o
objetivo de aferir o seu grau e coerência de aplicabilidade.
Numa abordagem mais ampla, importa enumerar e clarificar os instrumentos de
atuação, em especial, no que se refere aos regimes jurídicos no âmbito da reabilitação
urbana que, nos últimos anos, se concretizaram e procuraram implementar no quadro de ação
nacional.
Numa abordagem mais específica, importa o entendimento do RJRU na sua aplicação e
articulação entre a política de reabilitação urbana e a política urbanística municipal.
A política de reabilitação urbana, que envolve fatores de natureza social, económica,
ambiental e cultural, tem de estar devidamente integrada na política urbanística municipal
sendo determinante aferir a aplicabilidade do RJRU enquanto indicador da orientação e
capacitação dos municípios tanto ao nível da estratégia como da operacionalização.
Neste sentido, são sistematizadas e analisadas as ARU’s vigentes, que resultam de
publicação em Diário da República, permitindo estabelecer um levantamento da aplicação do
RJRU no quadro da ação municipal.
Urban rehabilitation or renewal is an unavoidable topic among stakeholders when intervention work is intended within a city. When it is an integrated process, it involves an approach which is based not only on the physical rehabilitation of buildings, but also on the specific elements of the area to be rehabilitated, its needs and potential in all its diverse dimensions. Within the current context, when considering urban dynamics which are linked to socioeconomic factors, it is important to enumerate and interpret the instruments available and the action of the stakeholders. This thesis focuses on the current instrument of action within the scope of urban renewal, the Legal Framework for Urban Renewal (LFUR) (RJRU), and analyses the impact of its application and operations within the context of municipal action in order to assess the degree and coherence of application. At a broader level, it is important to list and explain the instruments of action specifically within the context of legal frameworks within urban renewal which, within recent years, have been designed and implemented within the framework of national action. At a more specific level, it is important to understand the LFUR (RJRU) as it is applied and articulated between urban rehabilitation and municipal town planning policies. Urban renewal policy, which involves social, economic, environmental and cultural factors, needs to be properly integrated within municipal town planning policy as it is a determining factor in order to assess the applicability of the LFUR (RJRU) as a guidance and capability indicator for towns, both at a strategic and operational level. In this context, current areas for urban renewal (AURs), as published in the Diário da República (the Portuguese Official Gazette of the Republic), are systematised and analysed in order to assess the application of the LFUR (RJRU) within municipal action.
