Ao longo da última década, o fluxo de migrações forçadas tem refletido uma trajetória
de crescimento exponencial, ultrapassando em 2022 a barreira dos 100 milhões de
pessoas forçadamente deslocadas. Este cenário motivou a renovação de apelos na
comunidade internacional para a urgência em reformular o regime internacional dos
refugiados. No entanto, serão as propostas alternativas capazes de resolver eficazmente
os problemas estruturais, dependências institucionais e deficiências operacionais que
continuam a caracterizar este regime? A presente dissertação tenta responder a esta
pergunta ao realizar uma análise crítica e comparativa de três visões alternativas para
reformar a governança global dos refugiados. Com base numa abordagem construtivista
e através do método da crítica imanente, as três propostas de reforma serão analisadas
face à sua capacidade de responder aos três principais problemas sinalizados na
literatura sobre o regime internacional para os refugiados: a existência de discrepâncias
e ambiguidades conceptuais na definição do refugiado, a inexistência de partilha de
responsabilidades e, por fim, a falta de modelos de integração dos refugiados. Através
desta análise, a presente investigação pretende compreender até que ponto estes três
modelos alternativos de governança global dos refugiados consideram e resolvem cada
um destes desafios e, nesse sentido, contribuir para o debate contemporâneo sobre a sua
potencial reforma.
Over the last decade, the flow of forced migrations has been on a trajectory of exponential growth, surpassing the barrier of 100 million forcibly displaced people by 2022. This context prompted renewed calls from the international community that signalled the urgency of reforming the international refugee regime. Nonetheless, are these alternative proposals capable of effectively resolving the structural problems, institutional dependencies and operational deficiencies that continue to characterize the international refugee regime? This dissertation attempts to address this question through a critical and comparative analysis of three alternative visions for reforming the global refugee governance. Based on a constructivist approach and using the method of immanent critique, the three reform proposals will be analyzed in terms of their ability to respond to the three main problems identified in the literature on the international refugee regime: conceptual discrepancies and ambiguity in the refugee definition, lack of responsibility sharing and lack of models regarding the integration of refugees. Through this analysis, this dissertation aims to understand the extent to which the three alternative models of global refugee governance consider and can potentially resolve each of these challenges and, in doing so, contribute to the contemporary debate on its potential reform.
