Abstract(s)
O presente trabalho discute, a partir do escândalo que ficou conhecido como “vaza jato”, se
há, no decorrer da operação Lava Jato no brasil, indícios claros de interferência de um poder
sobre outro. A identificação dessas interferências coloca em causa a quebra do
comprometimento descrito na constituição de 1988 com o preceito teórico do Pesos e
Contrapesos estipulado por Montesquieu. Esta pesquisa nasce da vontade de verificar se os
dados vazados são suficientes para afirmar se essa ruptura ocorreu ou não na prática. Para
desenvolver esta pesquisa recorremos a uma revisão bibliográfica de autores que, ao se
dedicarem a estipular um ordenamento social baseado na divisão dos poderes, se tornaram pais
da matéria. Para além, confrontamos a perspectiva teórica com os casos práticos oferecidos
pelos veículos de comunicação responsáveis por publicitar os vazamentos. Por fim, e com igual
relevância, buscamos depoimentos de especialistas que, ao enxergarem para o assunto de uma
maneira macro, depuseram de modo a oferecer, mediante suas competências, um diagnóstico
desse escândalo. Verificar se houve ou não interferências entre os poderes nos permite,
categoricamente, verificar o nível de credibilidade que as instituições que personalizam os três
poderes no Brasil podem recobrar sobre si
The following paper discuss, based on the scandal known as “Jet Leaks”, if during the “Car Wash” operation in Brazil, there was any indications of interference of one power over another. The identification of those interferences may let us think that the theoretical precepts of Montesquieu's checks and balances, one of the pillars of the 1988 Constitution are being broken. This paper comes from the will of verify if the leaked data is enough to affirm that this political rupture happened. In order to develop this research we did a bibliographical revision of authors that are specialized on the subject. Besides that, we confronted the theoretical perspective with practical cases offered by the media vehicles responsible for publishing the leaks. Finally, and with equal relevance, we searched for the opinion of specialists on the matter, that see the situation with a wider view, offering, according to their competences, a diagnostic of the situation itself. Verifying if there was an interference in between the powers or not, allow us to analyze the level of credibility between the institutions that personalize the three powers in Brazil.
